Signature Smile Dental Studio — Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL AND DENTAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Effective date: January 1, 2026
This notice applies to Signature Smile Dental Studio, 9900 Stockdale Hwy, Ste 201, Bakersfield, CA 93311, and to every dentist, hygienist, assistant, and staff member who works here. It explains how we use and share your health information, what rights you have, and what we must do to protect your privacy.
If you have questions about this notice, contact our Privacy Officer, Dr. Roger Pham, at (661) 664-9900 or hello@signaturesmiledentalstudio.com.
Our responsibilities
The law requires us to protect the privacy and security of your health information. We must:
- Keep your protected health information private, as required by federal law (HIPAA) and California law.
- Give you this notice of our legal duties and privacy practices, and follow the version that is currently in effect.
- Tell you promptly if a breach happens that may have compromised the privacy or security of your information.
- Not use or share your information in ways other than those described here unless you give us written permission. If you give permission, you may change your mind at any time by telling us in writing.
How we use and share your information
We use and share your information mainly to treat you, get paid for your care, and run our office. We do not need your written permission for these uses.
- To treat you. Our dentists and team use your health history, X-rays, photos, and records to plan and provide your care. We may share them with other providers involved in your care, such as a specialist, your physician, a pharmacy, or a dental lab making your crown or appliance.
- To bill for your care. We share information with your dental insurance or the person responsible for your account to get paid. Example: we send your insurance a claim listing the treatment you received.
- To run our office. We use information to check the quality of our care, train our team, and manage our business. Example: we review charts to make sure treatment notes are complete.
- Appointment reminders and office messages. With your consent, we contact you by text message, email, or phone about appointments, confirmations, forms, treatment, and billing. Texts and calls come from our office number, (661) 664-9900. You can stop texts at any time by replying STOP or telling our front desk.
- Our service partners. We use companies that help us run the office, such as our practice-management software, patient-messaging service, and secure document storage. Each signs a business associate agreement and must protect your information the same way we do.
- Family and friends involved in your care. Unless you object, we may share information with a family member, friend, or other person you name who is involved in your care or helps pay for it. On your intake forms you tell us who, if anyone, we may speak with. If you are not able to tell us, such as in an emergency, we may share information if we believe it is in your best interest.
- Parents and guardians. For a patient under 18, we generally share information with the parent or legal guardian, except where California law gives the minor the right to control certain information.
Other ways the law lets or requires us to share information
We may also share your information without your written permission in these situations, only as the law allows and only the minimum needed:
- When required by law, including when the U.S. Department of Health and Human Services checks that we are complying with privacy law.
- Public health and safety, such as reporting disease, reporting reactions to medications or problems with dental products, or helping with product recalls.
- Abuse, neglect, or domestic violence. As mandated reporters, we must report suspected child abuse or neglect, and suspected abuse of elders or dependent adults, to the proper authorities.
- Serious threats to health or safety, to help prevent a serious and imminent threat to you, another person, or the public.
- Health oversight, such as audits, investigations, and licensing reviews by the Dental Board of California and other agencies.
- Lawsuits and legal proceedings, in response to a court order, and in some cases a subpoena or other lawful request.
- Law enforcement, in limited cases, such as to identify a suspect or missing person, or as required by a warrant or court order.
- Identification of a deceased person. Dental records are often used to identify people. We may share information with coroners, medical examiners, and funeral directors.
- Organ and tissue donation, with organizations that handle donation and transplantation.
- Research, only when an approved process protects your privacy.
- Workers’ compensation, for work-related injury claims.
- Special government functions, such as military, national security, and protective services, as the law requires.
Uses that need your written permission
We will never do the following without your written permission:
- Marketing. We will not use your information to market other companies’ products or services to you. Reminders about your own care and our own services are not marketing.
- Selling your information. We never sell your health information.
- Photos for marketing. We take photos of your face, mouth, and teeth for your dental record. We use them on our website, social media, or advertising only if you sign our photo release. You may cancel that permission in writing at any time.
- Psychotherapy notes. We do not keep these, but if we ever received them, we would not share them without your permission.
Any other use not described in this notice also requires your written permission. You may cancel a permission at any time by telling us in writing. Canceling does not undo anything we already did with your permission.
Your rights
You have the following rights about your health information. To use any of them, contact our Privacy Officer. We may ask you to make some requests in writing.
- Get a copy of your records. You may see or get a copy of your dental and billing records, on paper or electronically. We will respond within the time required by federal and California law. We may charge a reasonable, cost-based fee for copies.
- Ask us to correct your records. If you think information in your record is wrong or incomplete, you may ask us to correct it. We may say no, but we will tell you why in writing within 60 days.
- Ask for confidential communications. You may ask us to contact you in a certain way, such as only by cell phone or at a different mailing address. We will agree to reasonable requests.
- Ask us to limit what we use or share. You may ask us not to use or share certain information for treatment, payment, or our operations. We do not have to agree, and we may say no if it would affect your care. If you pay for a service in full out of pocket, you may ask us not to share information about it with your health plan, and we will agree unless a law requires us to share it.
- Get a list of who we shared your information with. You may ask for a list of the times we shared your information in the six years before your request, who we shared it with, and why. The list does not include sharing for treatment, payment, or our operations, or sharing you asked us to make. We provide one list a year free; we may charge a reasonable fee for more.
- Get a copy of this notice. You may ask for a paper copy at any time, even if you agreed to get it electronically.
- Choose someone to act for you. If you have given someone medical power of attorney, or someone is your legal guardian, that person can use your rights and make choices about your health information. We will confirm they have this authority first.
- Be told about a breach. We will notify you if a breach affects your unsecured health information.
California law and specially protected records
Where California law protects your information more than federal law, we follow California law. This includes the California Confidentiality of Medical Information Act, which limits how health care providers share medical information, and laws that give extra protection to information such as HIV test results, mental health records, and certain care that minors can consent to themselves.
If we receive records from a federally assisted substance use disorder treatment program (protected by 42 CFR Part 2), we will not use or share them in any civil, criminal, administrative, or legislative proceeding against you unless you give written consent or a court orders it, as the law allows.
Changes, questions, and complaints
We may change this notice, and the changes will apply to all information we have about you. The current notice is posted in our office and on our website, and you may ask for a copy at any time.
If you believe your privacy rights have been violated, you may file a complaint with us or with the federal government. We will not retaliate against you in any way for filing a complaint.
